Terms and Conditions for Media Duplication
ALL ORDERS PLACED FOR DUPLICATION & REPLICATION, CUSTOMERS ARE DEEMED TO HAVE READ AND UNDERSTOOD THE TERMS AND CONDITIONS BELOW. ANY QUERY RELATING TO THESE TERMS AND CONDITIONS SHOULD BE MADE IN WRITING TO WILSON CREATIVE BEFORE ANY DUPLICATION OR REPLICATION JOB IS STARTED.
MASTER CD CONTENT FOR DUPLICATION & REPLICATION
Master CD’s must NOT be multisession. (data/audio to be written to the CD-R and the disk closed in one session) we require masters to be wriiten in DISK-AT-ONCE MODE (DAO). Please be sure your CD master has been checked for errors / glitches as no checks are undertaken on your master before the duplication/replication process. All CD Masters (CONTENT) will be stored by Wilson Creative unless otherwise instructed. Charges will apply if Wilson Creative has to create a master disc from supplied or downloaded digital files. Whilst every effort is made to ensure that all digital files have been downloaded correctly, information embedded onto the master and track listing create correctly, Wilson Creative take no responsibility should errors or mistakes relating to the creation of the master disc arise. To avoid errors we strongly recommend clients to supply a duplication ready master disc which has been checked thoroughly and made using a high quality CDr. Track listing information, ISRC, images and any other embedded hidden content on Audio discs can not be guaranteed to display correctly on all CD players. Wilson Creative take NO responsibility for data/audio errors on duplicated CD’s should your master contain errors.
MASTER DVD VIDEO FOR DUPLICATION & REPLICATION
DVD Masters must be created on reputable DVD Authoring software.
We recommend any of the following:
Sonic Scenarist – DVD Maestro – Apple DVD Studio Pro – DVD Lab Pro . A DVD-R can be used as a master for DVD5 (under 2 hours)
replication jobs. DVD9 (over 2 hours) jobs must be supplied on DLT (NOT DVD-DL) Encryption (CSS) CANNOT be added to DVD-R MASTERS
SUBMITTED ARTWORK FOR DUPLICATION & REPLICATION JOBS
All artwork must be submitted on CD-R (unless artwork by email has been approved) . Artwork must be submitted in one of the following formats: ( TIF – PSD(flattened) – PDF ) or JPEG as a last resort.
Artwork must be submitted in CMYK format.
Artwork must be at a minimum of 300 dpi
(PLEASE NOTE: NOT CONVERTED TO 300 DPI FROM A LESSER DPI RESOLUTION).
Submitted artwork files are archived on DLT. No submitted artwork CD’s are stored by Wilson Creative.
Wilson Creative will not be held responsible for any errors to artwork submitted by the client. Please make sure to check all wording and imagery before submitting.
COLOUR MATCHING/ONBODY PRINTING
We do not colour match for cd/dvd inlays and onbody print for in house jobs. All duplication orders are printed directly onto white body or silver body disks (please specify a preference when ordering) using Thermal Retransfer print technology. Replication orders >1000 units are screenprinted. With duplicated orders you may expect a + or – 10% variance in colour for CMYK supplied artwork. Wilson Creative reserves the right to, should the need arise due to equipment failure or to meet a specific deadline, use multiple duplication and printing equipment. The use of multiple machines can cause a + or – 10% variance in print colour output.
PROOFING
Artwork supplied by the customer is deemed to have been checked and no further proof required. If a proof of artwork is required you must request this via email at time of ordering. PDF proofs are provided free of charge. Hard copy proofs of CD and DVDs with and without label prints are also available for an additional charge of £35. All proofs must be signed off and dated quickly in order to avoid delays. We will not proceed without approval of all proofs. We will not be held liable for any errors not corrected by you.
Due to differences in equipment, processing, substrates, paper, ink and pigments and other conditions between colour proofing and production room operations, reasonable variations between colour proof and completed job will constitute acceptable delivery.
CD-R AUDIO DUPLICATION
We do not accept CD Audio masters created on standalone Audio Recorders on Audio Disks.
We have found these discs to be incompatible at times with the duplication/replication process. These disks must be remastered and checked. We can do this at a cost of £25 per master. Audio masters CREATED on a PC or MAC are acceptable. We require masters to be wriitten in DISK-AT-ONCE MODE (DAO). We do not guarantee that all duplicated CD-R disks will work in all CD players. Car CD players in particular may tend to reject certain CD-R duplicated disks. To combat this we suggest that you take delivery of a test disk before committing to a large CD-R run.
CD AUDIO DUPLICATION COPYRIGHT
By placing an order to have Wilson Creative duplicate or replicate an Audio CD. You certify that you own the copyright to any material copied to CD. If you are not the copyright owner, you hereby certify that you have requested and have been granted permission by the copyright owner to use the material in the manufacture of a CD. In the event any person, entity, or agency contests, disputesw or challenges Wilson Creative regarding replication/duplication of any CD. You agree to indemnify Wilson Creative and hold Wilson Creative, harmless from all legal expenses that may be incurred by Wilson Creative, as well as all damages infringement of any patent, copyright, trademark, trade dress or trade secrets.
MINI CD (8cm) DUPLICATION PROBLEMS
We have found that duplicating cross-platform (hybrid) data masters onto Mini CD’s is not condusive with our duplication equipment. We have also had some problems with “mixed” mode CD’s (data + audio). We recommend using 5″ CD’s for these jobs.
CD BUSINESS CARD DUPLICATION (50MB)
Please send the master content for CD Business Cards on a separate 5″ CD-R. We expect all data for CD Business Cards to be under 50MB total. Do not use CD Business Cards in CD half cut drives (ie. MAC half cut ROM drives). Do not use CD Business Cards in “drag In” CD ROM drives (only drives with trays) CD Business Cards are not guaranteed to work in all laptop machines. CD Business Cards are not recommended for use as CD Audio.
DVD-R DUPLICATION
We do not guarantee that all DVD-R’s will work in all stand-alone DVD players.
The reason for this is:
1) Certain DVD stand-alone players are not designed to play this format.
2) Certain DVD stand-alone players may reject the DVD-R dye colour
We only use Taiyo Yuden and MBI DVD-R disks for our DVD duplication runs. We find these disks to be most compatible with stand-alone machines. The current statistics show that 75%-85% of stand-alone DVD players will play this format.
DVD DUPLICATION OPTIONS:
1) Take delivery of a test disk before a large run.
2) Opt for DVD Replication (99.8%) compatibility.
PACKAGING & PRINTED PAPER PART ORDERS WITHOUT DUPLICATION
Orders for media packaging and/or printed paper parts which are not part of a duplication order will be subject to a percentage surcharge on top of the unit prices listed on this website.
Packaging will be subject to a 18% surcharge.
Printed paper parts, <500 units, will be subject to a 30% surcharge and >500 will be subject to a 18% surcharge.
PRICE MATCH PROMISE
We already believe we offer the best value CD Duplication service in Northern Ireland and the UK. But if you have received a quote for CD Duplication which is lower than ours then simply send us the quote and we will match it and give you a further £5 discount. If we cannot match the quote we will give you the fiver anyway just for enquiring.
Conditions of Price Match
1) Quote must be for like for like product – Grade quality of CD/DVD and packaging must match our A grade standard. If quote is for lower standard, we reserve the right to refuse to match or pay the price match promise
2) All quotes must be from an established reputable registered CD/DVD duplication company from within Northern Ireland. Quotes from ebay or other individuals offering duplication services will not be accepted. Quotes from outside NI will not be accepted.
3) Minimum quantity of 100 discs must be quoted for. Quotes for less than 100 discs will not avail of the price match promise promotion.
4) The Price Match Promise relates to duplication of media only and excludes paper parts printing and packaging.
DELIVERY
All delivery dates are estimates unless we confirm the date in writing. We will use a next day delivery courier service in most instances. Next day delivery is only to NI addresses, ROI or UK mainland deliveries will be sent via 48hour courier. Timed and same day deliveries are available at extra cost (NI only).
If you are unavailable to receive a delivery to the address you provided, you will be billed for any charges incurred by further delivery attempts.
We will not be liable for any loss arising out of any delay in delivery. It is your responsibility to ensure the product is completed before crucial events are scheduled (eg launch parties or trade shows.).
We reserve the right to make partial shipments.
RETURNS AND ERRORS
You will inspect all goods on receipt and notify us within 48 hours of any damages or shortages. Reports of damages after 48 hours will not be entertained. This limit is in place to allow us to make a claim against our carriers or insurers.
We will replace or refund any goods which are proved to be defective due to poor workmanship or material. A sample of the product, as well as a written description of the fault must be submitted to us before a decision is made. No product will be replaced or refunds given, if notification is more than 7 days after receipt of the goods. Refunds will be pro rated based on the quantity of goods returned to us.
We reserve the right to request that all products be returned for our inspection.
Our liability for goods proven to be defective shall not exceed the invoiced price of the goods. We shall not accrue any liability for any indirect or consequential loss on defective or delayed goods, including but not limited to loss of profit by you.
ANTI-PIRACY
By placing your order, you confirm that your material does not violate any local or international laws or infringe any copyright, privacy, trademark, patent, personal or intellectual property rights. Your material does not contain any defamatory, libellous or offensive material.
You agree to indemnify us from and against all claims, demands, suits or proceedings brought against us in connection with your material. You agree to defend and indemnify us for all liabilities, damages, costs and expenses suffered by us as a result of said claim or action.
It is your responsibility to contact the MCPS concerning any royalties or fees due on your music. We require proof that the MCPS has approved your title for manufacture before we proceed with your job. We will not manufacture any audio products without the necessary license. If we have reason to believe that you are not the rightful owner of any data, we reserve the right to discontinue reproduction.
CANCELLATIONS
All cancellations must be submitted in writing. In the event of cancellations after the submission of your master disc and artwork, you will be charged for all the work done and all materials used until the point of cancellation. A cancellation charge may also be applied.
OVERDUE AND LATE PAYMENTS (Credit Customers Only)
Wilson Creative, reserves the right to charge interest (8%) on overdue invoices in accordance with The Late Payment of Commercial Debts (Interest) Act 1998 as well as a compensation entitlement of up to £100 (depending on size of unpaid debt). Accounts with overdue payments exceeding 60 days will automatically be referred to the small claims court for action.
OVERDUE AND LATE PAYMENTS (Prepay Customers Only)
Payment of all orders on prepay accounts are due on receipt of invoice and are not subject to any credit terms. Late payments are subject to a 10% total value late fee followed by recurring interest charges of 8% in line with Late Payment of Commercial Debts Act 1998. Accounts with overdue payments exceeding 30 days will automatically be referred to the small claims court for action.
GENERAL
Quotations do not constitute an offer and may be withdrawn or modified until a final agreement is made in writing on official headed paper.
Quotations not accepted within thirty days will be subject to review.
We reserve the right to refuse any order.
We may use your product as a sample for prospective clients. The CD/DVD will be scratched or otherwise made unusable. It will only be used to illustrate print quality. Please advise us if you do not want your product to be used.
We will not be responsible for failure to fulfil our obligations if such failure is caused by circumstances beyond our control or those of our contractors and suppliers including but not limited to strikes, flood, accidents, equipment failure or transportation delays.
Wilson Creative can not be held responsible for any costs incurred to our clients due to late delivery of products or manufactured items produced by Wilson Creative.
Wilson Creative cannot be held responsible for any damage caused to equipment used in the playback of duplicated and/or replicated CD/DVD discs.
All goods remain the property of Wilson Creative until paid for in full.
